Terms of Service

1. Agreement to Terms

By accessing or using BookSA's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Description of Services

BookSA provides online booking system services for South African businesses including guesthouses, B&Bs, and tour operators. We facilitate online bookings and payment processing through our platform.

3. Service Fees

BookSA charges a 12% commission on successful bookings. This fee is automatically deducted from the booking amount before payment is transferred to the business owner. There are no monthly subscription fees.

4. User Responsibilities

  • Provide accurate business and contact information
  • Maintain up-to-date availability and pricing
  • Honor all confirmed bookings
  • Comply with all applicable South African laws and regulations

5. Payment Terms

Payments are processed through Paystack. Business owners will receive booking payments (minus BookSA's 12% commission) within 2-5 business days of a confirmed booking, subject to Paystack's settlement terms.

6. Limitation of Liability

BookSA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our services. Our total liability shall not exceed the fees paid to us in the 12 months preceding the claim.

7. Termination

Either party may terminate this agreement at any time with 30 days written notice. BookSA reserves the right to suspend or terminate accounts that violate these terms.

8. Governing Law

These terms are governed by the laws of South Africa. Any disputes will be resolved in the courts of South Africa.

Privacy Policy

1. Information We Collect

We collect information you provide directly (business details, contact information), automatically (usage data, cookies), and from third parties (payment processors, customers making bookings).

2. How We Use Information

  • Process bookings and payments
  • Send booking confirmations via WhatsApp and email
  • Improve our services and user experience
  • Comply with legal obligations

3. Information Sharing

We share information with payment processors (Paystack), communication services (WhatsApp Business API), and as required by law. We do not sell personal information to third parties.

4. Data Security

We implement appropriate security measures to protect your information, including encryption and secure data transmission protocols.

5. Your Rights

Under POPIA (Protection of Personal Information Act), you have the right to access, correct, or delete your personal information. Contact us to exercise these rights.

Refund Policy

1. Business Owner Refunds

BookSA's 12% commission is non-refundable once a booking is confirmed, regardless of subsequent cancellations or modifications by the customer or business.

2. Customer Refunds

Customer refunds are handled directly between the customer and the business owner. BookSA does not process customer refunds but may facilitate communication between parties.

3. Technical Issues

If a booking fails due to technical issues on BookSA's platform, we will work to resolve the issue promptly. If resolution is not possible, any fees charged will be refunded.

4. Dispute Resolution

In case of disputes, we encourage direct communication between parties. BookSA may assist in mediation but is not responsible for resolving booking disputes.

Cancellation Policy

1. Service Cancellation

Business owners may cancel their BookSA service at any time by providing 30 days written notice. All pending bookings must be honored during the notice period.

2. Booking Cancellations

Individual booking cancellations are governed by the specific cancellation policy set by each business owner. BookSA facilitates communication of these policies but does not enforce them.

3. Force Majeure

In cases of force majeure (natural disasters, government restrictions, etc.), standard cancellation policies may be waived at the discretion of the business owner.

4. No-Show Policy

No-show policies are determined by individual businesses. BookSA's commission applies to all confirmed bookings regardless of customer attendance.
